California Proposition 65 Disclosure

California’s Proposition 65, officially known as the Safe Drinking Water and Toxic Enforcement Act of 1986, requires businesses operating in California to provide warnings before exposing consumers to chemicals identified by the State of California as potentially causing cancer, birth defects, or other reproductive harm.

The State of California, through the Office of Environmental Health Hazard Assessment (OEHHA), maintains and updates a list of these chemicals. The list currently contains several hundred substances, many of which may occur naturally or in trace amounts in food, dietary supplements, and consumer products.

Why This Disclosure Exists

Proposition 65 does not prohibit the sale of products containing listed substances. Instead, it requires a “clear and reasonable warning” when a consumer’s exposure to a listed chemical exceeds California’s established threshold levels.

These thresholds are often significantly lower than exposure limits set by federal agencies and international health organizations.

FITHEALTHCO.COM ROLE

FITHEALTHCO.COM is an independent retail reseller of branded products. We do not:

  • Manufacture products
  • Formulate ingredients
  • Alter product composition
  • Perform chemical or toxicological testing
  • Determine whether a Proposition 65 warning is required

All product labeling, ingredient disclosures, testing, and compliance determinations — including whether a Proposition 65 warning applies — are made by the product’s manufacturer or brand owner.

Notice to California Consumers

Out of an abundance of caution, California residents should assume that any product sold by FITHEALTHCO.COM may expose the consumer to trace amounts of chemicals listed under Proposition 65, even if a specific warning is not visible on the product label or product page.

This disclosure is provided to ensure transparency and allow California consumers to make informed purchasing decisions.

Proposition 65 Warnings and Product Safety

The presence of a Proposition 65 warning does not mean a product is unsafe or defective. California’s warning thresholds are frequently set at levels far below those established by:

  • The U.S. Food & Drug Administration (FDA)
  • The U.S. Environmental Protection Agency (EPA)
  • The World Health Organization (WHO)

Many products that are lawful for sale nationwide may still require a Proposition 65 warning in California.

Variations in Warning Labels

Warning labels may differ depending on:

  • Whether the product was packaged for California distribution
  • Manufacturer-specific labeling practices
  • Inventory produced prior to updated warning requirements

The absence of a visible warning does not necessarily indicate that a product is exempt from Proposition 65.
